In majority of cases, employers need an Labour Market Impact Assesment (LMIA) before they can offer a job to a foreign worker.
An LMIA serves as a confirmation that:
- there is a necessity to hire a foreign worker in order to fill labour shortages
- no Canadians or permanent residents are available to do the job
TYPES OF LMIA
There are 4 different types of LMIA :
LMIA for high-wage workers
LMIA for low-wage workers
LMIA for workers applying through the Seasonal Agricultural Worker Program
LMIA for workers applying through the Agricultural Stream
What should a successful LMIA application demonstrate?
your efforts to hire Canadian citizens/permanent residents for the position
wages offered to a foreign worker are consistent with the prevailing wage paid to Canadians for the same position
working conditions meet the local labour market standards
the benefit of hiring a foreign worker for the Canadian labour market
transition plan (for high-wage LMIA application) in which the employer presents a long-term plan for hiring more Canadians/permanent residents
